Collision with a pedestrian or cyclist
Cyclists or pedestrians are considered weaker road users. Because they are vulnerable in traffic, the law provides for a special regulation in the event of a collision with a motor vehicle. Based on the age of the cyclist, the owner of the motor vehicle is wholly or partially liable for the cyclist's damages. Normally, after an accident, you have to prove that the other party is liable. This does not apply when a cyclist or pedestrian has been struck by a motor vehicle; car, motorcycle, moped, light moped, etc. According to the law, in this case, the driver of the motor vehicle is liable until the driver can prove that there was a case of force majeure. Perhaps unfair... but the cyclist or pedestrian does run a greater risk of more serious injury from, for example, a car or moped.
If you are involved in an accident with a pedestrian or cyclist, you are more likely to be held liable than if you have a collision with a motorized vehicle.

Recoverable damage components
If you are personally liable for an accident, we will contact the opposing party and handle the claim with them. Is the opposing party liable for the accident? Then we will assess the damages for you and recover the various components of the damage from the opposing party.
By damage components we mean:
• Damage to, for example, the car, moped, scooter, electric bicycle, etc. • Costs for replacement transport. • Material damage. Think, for example, of damage to clothing. What is the Motor Vehicle Guarantee Fund?
Was your parked car hit, but you do not know by whom? Is there someone who can testify that you parked the car undamaged and found it damaged? Then the damage might be recoverable from the Guarantee Fund. Does the damage meet the conditions below? If so, please mention this when reporting the damage.
Conditions of the Guarantee Fund: • The damage must have been caused in the Netherlands. • The damage must have been caused by a motor vehicle. This will be determined by an expert at the repair shop. • A report must be filed with the police within 14 days of the accident. • You must be able to name at least one person as a witness. • You must have filled out a European accident report form. • The repair costs are higher than €250. **
Good to know** The Guarantee Fund applies an excess of €250. However, as an extra service, we do not pass this on.
