Good to know if you have to deal with damage

Bikers or pedestrians are considered weaker traffic participants. Because of their vulnerability in traffic, the law has a special regulation in case of a collision with a motor vehicle. Based on the age of the biker, the owner of the motor vehicle is fully or partially liable for the damages of the biker. Normally, after an accident, you have to prove that the other party is liable. This does not apply when a biker or pedestrian has been hit by a motor vehicle; car, motorbike, scooter, etc. According to the law, in this case, the driver of the motor vehicle is liable, until the driver can prove that there is a case of force majeure. Perhaps unfairly...but the biker or pedestrian does run a greater risk of being more severely injured by, for example, a car or scooter. If you are involved in an accident with a pedestrian or biker, you will be held liable sooner. Then when you are involved in a collision with a motorized vehicle. Do you have to deal with this? If you are responsible for an accident, we will contact the other party and settle the claim with them. Is the other party responsible for the accident? Then we will assess the damage for you and recover the various damage components from the other party.
With damage components we mean:
Damage to, for example, the car, scooter, motorbike, electric bicycle, etc.
Costs for replacement transportation.
Material damage. For example, damage to clothing. We can recover the damage based on the current value.

Has your car been hit while parked, but you don't know by whom? Is there anyone who can testify that you parked the car without damage and found it with damage? Then it may be possible to recover the damage from the Guarantee Fund. Does the damage meet the conditions below? Mention this when reporting the damage.
Conditions of the Guarantee Fund:
The damage must have been caused in the Netherlands.
The damage must have been caused by a motor vehicle. This will be determined by an expert at the damage repair company.
Within 14 days after the accident, a report must have been made by the police.
You must be able to name at least one person as a witness.
You must have completed a European accident statement.
The repair costs are higher than € 250.
Good to know The Guarantee Fund maintains an excess of € 250. Is the contractual excess lower? LeasePlan will pay the difference.
